1. Acceptance of Terms
By using the Service, you agree to these Terms and the attached policy agreements (Privacy Policy, Acceptable Use Policy). If you do not agree, do not use the Service.
2. Eligibility & Customer Account
You must be legally authorized to enter into contracts on behalf of yourself/your company. You are responsible for the accuracy of registration data, protecting login credentials, and notifying us immediately of any unauthorized use.
3. Service & WhatsApp Integration & Third Parties
The Service integrates with WhatsApp and other providers. You are responsible for complying with their terms (e.g., WhatsApp/Meta terms) and obtaining necessary consents from your contacts. We are not:
- Affiliates or representatives of WhatsApp/Meta.
- Responsible for their technical/policy changes that may affect the Service.
4. Customer Content & Messages
You retain all rights to your content. You grant us a worldwide, non-exclusive, limited-purpose license to operate the Service, process/route messages, host knowledge files, create backups, and improve performance. You alone are responsible for the legal compliance of your messages/campaigns.
5. Acceptable Use — Prohibited
- Spam/harassment, collecting numbers without consent, or circumventing WhatsApp policies.
- Illegal, fraudulent, abusive, hateful content, or violating others' rights.
- Reverse engineering, tampering with platform security, or bypassing technical limits.
- Using automated outputs without human supervision in high-risk situations.
6. AI-Powered Outputs
AI produces probabilistic outputs that may be inaccurate or inappropriate. You must conduct appropriate human review and bear ultimate responsibility for your decisions.
7. Plans, Fees & Billing
- We offer free and paid plans, fair use limits, and overage fees.
- Monthly/annual billing through payment provider. Fees are non-refundable unless stated otherwise.
- We reserve the right to change prices/limits with reasonable advance notice.
8. Technical & Fair Limits
We apply limits on rate/volume to protect the platform and users. Exceeding them may result in temporary or permanent suspension.
9. Suspension & Termination
We may suspend/terminate access if you violate terms or your use poses a risk. You can terminate at any time through the account dashboard or written request. Upon termination: license ends and we delete or anonymize your data per privacy policy.
10. Intellectual Property
The platform, software, and related content are owned by us or our licensors. No rights are granted except as expressly stated in the terms.
11. Confidentiality
Each party commits to protecting the other party's confidential information and not using it except for service provision.
12. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, within the limits permitted by law.
13. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect/special/consequential damages, and our total liability is limited to an amount equivalent to the last 3 months' fees.
14. Indemnification
You agree to indemnify us against any claim arising from your use of the Service in violation of these terms or applicable laws.
15. Governing Law & Dispute Resolution
The contract is governed by the laws of Sultanate of Oman without conflict of laws. Disputes are resolved through Muscat courts or designated institutional arbitration.
16. Modifications
Terms may be updated. We will notify you of material changes, and continued use constitutes acceptance after they take effect.
17. Language Priority
When providing versions in Arabic and English, the Arabic version prevails in case of conflict unless otherwise stated.
